If a Magnitsky law is enacted it will apply to all affected by it and be enforced in accord with it. Failure by those responsible will be subject to judicial challenge. Until there is a law any comment about it is at best hypothesis.

After all the final investigation and result in Mr Litvinenko’s case was only got after a legal challenge by his widow and others.

I think that we can rely on our long adherence to the rule of law. Would that it were so everywhere.
