These deprivations of liberty apply not only in hospitals and care homes, but can take place in the home environment too. It's a much wider than report than reported.

The reason the existing safeguards don't work is quite simply that the system is clogged under the weight of unintended consequences. The obvious ways to solve this problem would be either to streamline the process into something of a rubber-stamping exercise, or to legislate to remove some classes of people from the scope of the safeguards. Either would sit uneasily with the idea of "protect[ing] peoples basic human rights".

It'll be fascinating to see what sort of solution can be found. On this government's form, my fear is that it will be a wholly unsatisfactory fudge. This seems to be clearly signposted by the refusal to extend the very same protection of these basic human rights to humans who happen to be children.
