IM do not have to refund the claimant anything as the success fee was paid by the defendant unlike post-LASPO.

A smelly case though I can understand the rationale for not using Legal Aid eg restrictive costs, ineffective procedures, restrictions on experts and ultimately a drain on public money. But if you had it in place, then don't switch just to make more cash.
