It is clear from the tone of Mr Rozenberg's comments that he is clearly in favour of marriage and resents Lady Hale and some of her erudite colleagues recognizing, at least in this instance, that living together is the equal of marriage. The principle that the courts should not make law is a sound one but Mr Rozenberg protests with some vehemence that bereavement benefits should not be extended to those who will not undergo a formal ceremony of legal marriage

One cannot help wondering that even if Parliament were to extend the benefit by appropriate statutory enactment and thereby address Mr Rozenberg's concern for constitutional propriety he would still oppose the extension.
