It seems as though the second defendant was dropped fairly early on by the claimant and I think those were probably decisive factors (whether expressed as such in the Judgment or not). Clearly, if a significant amount of work had been undertaken by the claimant investigating liability against both defendants and the one of them had then compromised the claim in full pre-issue, it would presumably be a different matter entirely.
