Please confirm what you mean by the term "it ought to be"

For example using JCG means the values in there are based on guidelines, most low value claims do not meet the guidelines and as such the valuation needs to be taken into account, hence the term GUIDELINE's
For example JCG Neck injury (c) Minor, the guidelines state:
"whilst the duration of symptoms will always be important, the LEVEL OF AWARD will also be influenced by factors such as:
.the impact of the injuries on the injured person's ability to work
.the extent of treatment required

So if no time taken off work and no rehab undertaken even though its "recommended" then the level of award would be less as per JCG yet still valuations made by claimant solicitors are always the top bracket of JCG?
