I thought the issue in whiplash injuries was that the medical reports rely far too much and often entirely on the report of the claimant and so it’s difficult to screen out a dishonest report. The lack of symptom verification linked into the sense of disproportionality.

But this definition is vague but looks set to cover a wide range of clinically observable and serious neck injuries. That seems to show its main intent is to benefit insurers.

It seems likely that there will be many disputes about what is and is not a whiplash injury and this legislation will soon fall into disrepute as serious injuries are woefully under compensated.
