The FCA has power to grant waivers, but it also publishes 'model' waivers, so that practitioners can get an idea of what a waiver might involve. Why this secrecy from the SRA regarding their waivers? And, if the terms of a waiver is said to be "commercially sensitive" then that can only mean that it is to the waivee's commercial advantage (which advantage would be compromised by disclosure of the waiver). How dare the SRA actively, but secretly, promote the commercial advantage of certain organisations over and above those other organisations and persons who remain bound by the unwaived rules and regulations. That is no part of their function. Surely the Legal Services Board should be asked to intervene against such maverick conduct by one of its regulators.
