I sincerely hope that this JR is successful. It’s annoying that the taxpayer will pick up the Bill for it in any event but that’s what happens when you have an MoJ with an agenda which they will pursue at all/any cost.

Aside from this raising an important access to justice issue, this case highlights just how much of a farce MoJ consultations are :

MoJ : Shall we consolidate the number of duty Court schemes ?

Response in consultation : No (say over 80% of those consulted).

MoJ : In that case, let’s go ahead with the scheme.

MoJ : Shall we introduce price competitive tendering ?

Response to consultation : No (say over 85% of those consulted)

MoJ : In that case, let’s go ahead with the scheme.

Presumably this pointless consultation process was a form of "going through the motions" so as to avoid any later complaint that they didn't even consult. To be fair, they can prove that they consulted, however they will have difficulty showing that they took the slightest bit of notice of the results of that process.
