I used to do med neg cases along with PI many years ago. I enjoyed helping people who had suffered serious harm recover compensation for their injuries and for future loss attributable to the negligence they had suffered.
What would make a better system is if Med Neg cases were put into a new Medical Injury Claims Tribunal overseen by medical practitioners sitting on the Tribunal who would establish liability, causation and compensation based upon written submissions, an analysis of the medical records and any assistance it felt was necessary from other experts together with an inquiry of the relevant medical practitione(s) and the Claimant. Fixed costs awarded to successful claimants. CFA's to "fund" the case.
I suspect that if the money currently spent on court time and administration for Med Neg cases was transferred to this specific Tribunal more cases could be dealt with more efficiently with no loss in compensation.
