Most insurers and claimant solicitors know that "phantom passenger" arguments are virtually impossible to run at trial without evidence.
As an insurer we ask lots of questions regarding allegations of phantom passengers but in reality most people involved in an RTA accident do not think about walking to the other vehicle and checking inside the vehicle for minors or other people and when questioned a few days or weeks after the accident this evidence has all but gone and as such the insurers have no defence, but claimant PI solicitors know this already hence their common phrase about everything is "prove it"
