No James Bowers, I rather think that the SC would have had to issue a declaration of incompatibility, leaving a legislative body to actually rewrite statute law.

Such reforms should not be judge-made, rather they should come from the legislature, which has much wider powers of consultation and social response and so legitimacy.

This is a case where the people need to support the change, not just be told it's needed by a committee of judges using 'human rights law' which has a relatively weak political capital.

Let MPs do the job they are there to do.

The SC has been wise in increasing pressure on MPs rather than trying to do judicial DIY.
