The much bigger debate is the disgraceful top end court fee of £10,000 that is in operation for larger personal injury claims - particularly spouses who are just over exemption limits pursuing fatal accident actions. The fees are massively overstated, wholly unjustified, and have been universally criticised by all, including the judiciary previously, without any review, or consideration.

The suggestion that the fees are largely charged to Oligarchs, or in larger commercial actions to fund the smaller actions is banal, and simply untrue.

I don't represent Oligarchs, or pursue multi billion pound actions, but have had clients with serious injury claims having to fund this disgracefully inflated fee. In she cases, the client has issued for a much smaller sum to be in a position to fund the court fee. If there's a barrier to access this is it - and how the MOJ can keep a straight face by suggesting litigation is too expensive, after slashing solicitors fees, and then increasing court fees on the other hand by 620% is simply astonishing.
