The wholesale practice of simply not disclosing to the defence items prejudicial to the prosecution case, or waiting until the last minute before doing so, is quite rightly under scrutiny. The essential problem still remains however, that both the Police and the CPS actively seek to avoid disclosure of anything that might be potentially helpful to the defence or unhelpful, though not necessarily prejudicial, to the prosecution case.
