On the question of privilege, the material is (subject to any alleged exception for iniquity) almost certainly privileged. The privilege belongs to the client and is his to waive. It is not for his lawyers to waive it without his express instructions. He therefore appears to have a claim arising out of its unauthorised disclosure by the paralegal.

So, who was the paralegal and at which firm is/was the paralegal working?
