Aah Progress.
I fondly remember the old days when divorces were dealt with by a circuit judge.
I particularly remember one occasion in the good old days before the Domestic Violence Act when one issued Judicial Separation petitions to enable ouster injunctions to be sought.
We all appeared in front of very fine Circuit Judge on a hearing for the injunction. He asked both parties, who were clearly incompatible, if the (very short marriage) was going to last, and the both said "no way" or similar.
The Judge then said:
"These parties do not want a judicial separation they want a divorce. I give permission to issue the divorce petition within the time limit (then 3 years). You Mr Newbery undertake to file the petition (in the same terms as the JS Petition) within 48 hours. I deem the petition served. I grant the Decree Nisi. I expedite the Decree Absolute. I grant the Decree Absolute. I grant the injunction in the terms sought. Is there anything else?"
No there was nothing else, and everyone was happy.
