the law is derived from morality !!?
Surely morality is a societal concept, which law-makers are frequently out of sympathy with.
First, "Thou shalt not kill", therefore death for any murder and, indeed, for lesser crimes. Then juries' morality started to change and they evaded imposing the law on, in their opinion, those who were clearly guilty but did not deserve the penalty. The law went on being applied by those who swear to do justice (but , oxymoronically, according to law) and evaded by the reps of society, until the law-makers surrendered.
Is that 'derivation'?
