I totally agree, I see cases daily where Defendants the day before trial are settling cases accepting Part 36 offers out of time knowing that the abated Brief fee of counsel is arguably not recoverable as the trial hasn't started which in essence costs the claimants and/or their solicitors more of their profit costs. Perde was an awful decision and makes the meaning of Part 36 offers on fixed costs cases meaningless. God help the Courts when more litigants in person cases start getting listed. The Court Timetable and ability to hear cases will grind to a halt! If I was a Judge I would go on strike!
