The judgment does not state the hourly rate claimed in respect of the SRA's Forensice Investigation Officer, but that rate is usually about £115 per hour. The judgment does state that Capsticks' "applicable hourly rate" was £113. It therefore appears that the rate claimed for the in-house FOI exceeds that claimed for the external solicitor, which seems odd.

However, the judgment also states (at [38]) that "the fee from Capsticks Solicitors was fixed". This seems to imply that Capsticks charged a fixed fee which equated to £113 per hour.

Are the more straightforward cases now prosecuted on a fixed fee basis?
