Low ball offers are based on the simple fact most low value claims don't meet the JCG guidelines and as such the JCG should not be used.
Its standard practice that claimant solicitors will go in high expecting a challenge so knocking £1000 off most claims is standard regardless

Thanks for telling me what Claimants' standard practice is, it's not like I've been defending PI claims for years.

The problem with saying most low value claims don't meet the JC Guidelines is that the evidence presented to us says otherwise. And for that you need to target dodgy GPs and medical experts rather than Claimants.

Alas this isn't about the past this is about the future. You and I both know that ALL claims will be lowballed, regardless of whether they 'meet the JC Guidelines' or not.

The only difference is, with no lawyer on the other side the lowball offer is more likely to be accepted by a LiP.

Is that bad? Yes, of course it is.

But good for your employer and my clients without doubt.
