You would think that Morrisons would be a bit hesitant to take a vicarious liability case to the supreme court after the result in Mohamud v Morrison Supermarkets [2016] UKSC 11

If an employer can be held liable for an entirely unprovoked brutal physical assault, then I think we are long past the point where the fact that an employee's actions were criminal mean vicarious liability cannot apply. It seems optimistic to expect the Supreme Court to have a completely different attitude than they did in 2016.
