I am dealing with a transaction where my clients' offer for a flat was agreed in February 2018. Draft papers were received shortly afterwards. I immediately identified that the lease plans (for a lease granted 20 years ago) were totally defective and we needed a deed of variation to replace them with proper plans. It took the seller 5 months to obtain plans; those plans needed to be revised three times due to inaccuracies; the freeholders have only recently instructed solicitors and have now decided that they want the lease plans for the other seven flats on the estate to be varied. We have not yet exchanged. There is no compulsion on the freeholder to extract their digits. How does Mr Prior suggest that the process in this scenario could be speeded up?
