It’s hard to see from the Law Society reports, why the SRA should have thought it in the public interest to bring this prosecution even if they were satisfied there was sufficient evidence of a regulatory breach. It’s noteworthy the SRA could instead have issued a rebuke or fined Mr Lewis up to £2,000 - close enough to the eventual SDT fine of £2,500 for the prosecution itself to be questioned (in retrospect at least) as disproportionate.
