Joshua, this is all about local authorities becoming risk-adverse after the Baby P case. Who wants to risk being the next Sharon Shoesmith and Haringey child welfare department? I think if you were to ask those at the Bar who do public law children proceedings, you would find that their fee income has increased substantially over the past ten years as a result of local authorities taking the attitude that, just as in the past nobody would be sacked if they bought IBM, throwing the issues over to a judge will mean they do not cop the blame if things go wrong.
