Being a claimant solicitor it's a little tempting to produce a wry smile at seeing a story like this (particularly given the judicial theme of punishing claimant defaults far harsher than a defendant's (IMO)) . That said, this is simply a ridiculous judgment and demonstrative of the ridiculous era we currently litigate within. Fine, sanction them in costs but to wipe out costs incurred for filing a budget late is frankly absurd.
