'nemo dat quod non habet', 'res ipsa loquitur', 'contra proferentem' were but three abbreviations for much longer propositions we used to use in pleadings but due to the Woolf reforms and in the interests of clarity we aren't allowed to use them anymore. On the other hand Skeleton arguments have replaced prolix pleadings as failed attempts to summarise long winded and often weak arguments. They are always (always) delivered on the door of the court and quote authorities no one has the time or inclination to check.
Can I respectfully crave your indulgence to humbly submit we ban them now please.
