Maybe any solicitors minded to participate in this should empowered to offer 'fixed hour' contracts to their clients, i.e. if the matter has not resolved itself within the number of hours work fixed, the contract is terminated leaving:

(a) the solicitor with no obligation to participate further on the client's behalf in the litigation; and
(b) the client free to negotiate a new contract either with the existing or a new solicitor.

In that manner small and medium sized businesses would know exactly the amount of their exposure to their own solicitor's costs and be able appropriately to budget for those.
