If he had really thought that the client was liable then he should have told the client to seek separate advice and issued contribution proceedings against the former client. Of course, those proceedings would have failed because it was the solicitor's negligence alone which caused the loss. Which is presumably why he tried to cover things up as he did. I wish people would realise that lying only ever makes things worse.
