If I have understood this correctly, ignorant prejudiced jurors are refusing to convict rapists. So what is the solution? The authors don't offer us one.
A jury trial is the common people's participation in the criminal justice system without which all aspects of criminal law, investigating, prosecuting, determining guilt or innocence and sentencing would be in the hands of the State. Whether it be smuggling, fraud, assault, indecency, rape or whatever offence one may chose, if the jury decides that the defendant's behavior does not amount to the alleged crime then so be it. The jury represent the views of the public; Perhaps it is the prosecutors who are out of step with Society? Also, aren't the authors assuming that police and prosecutors have no prejudices, personal or corporate when investigating and prosecuting sexual offences? Look at the number of rape cases that have had to be discontinued because of prosecution disclosure failures. Of course there are perverse verdicts and guilty men walking free but the
jury is the common man in court and that is the way we like.
