I disagree: the Article 50 case was, to my mind, correctly decided. The decision was a manifestation of the 'balance of powers' that acts as a brake on any part of the legislature (Crown, parliament or the courts) acting alone. It didn't make any difference to the eventual outcome, but it was entirely right that 'due process' should be followed. It is however disappointing that Lady Hale should feel able to comment in the way reported, as learning of her political views inevitably diminishes respect for her legal acumen.
