The claimant has already incurred £472,757 for witness statements alone, and I suspect these might be subject to challenge from the Defendant on assessment. Hourly rate arguments still have a huge impact on the incurred costs and I suspect that is what anon @ 14:17 meant. The explicit reference to a ‘proportionate’ hourly rate by Warby J has likely created an insurmountable hurdle for the Claimant later down the assessment line that no argument, however meritorious, will overcome.

The costs claimed are undeniably high, but specific comment on hourly rates really should be left to assessment, in my own (humble) opinion.
