It's all very well talking about an appeal, but the reality is that an appeal would not succeed and would leave Ms Scott with a significantly increased costs liability. The better way to deal with the matter was not to prosecute her, in return for an undertaking that she would not seek to return to practice.

It's extraordinary that the Law Society has had nothing to say (and no guidance to give) in the light of the James and Scott cases. Instead, its mouthpiece (the Gazette) publishes articles about Russian oligarchs which no one is interested in.
