If all crimes are the same, then why do we have sentencing guidelines for nearly every offence, setting out different levels of culpability, harm etc and which also deal with aggravating and mitigating features?? There is no question Miss Scott did wrong, it’s whether the punishment needed to be as severe as a strike off given all the circumstances of the case, many of which seem to have been accepted by the SDT. Troubling times for all.
