I read the stories on here about undisclosed commissions with horror.
But isn’t the issue identified in the report itself?

Referral fees are banned, but PI firms have got around the ban by calling them marketing fees.

Fixed recoverable costs were reduced by the rough equivalent value of the referral fee. If referral fees are still being paid (but in another name) the solicitor needs to make that money from somewhere else.
Hence the automatic deductions of 25% of client damages by using 100% success fees across the board.

Plus the secret ATE commissions.

If the ban had been effective and referral fees properly cut out of the picture, I would like to hope these solicitors would not have resorted to such tactics.
