It is a tax on the vulnerable but that fact won’t deter its implementation.

As was the case when the Court fees in civil cases increased, everyone was outraged and querying what enhanced service was being provided in return for the extra costs. Of course, there was no such enhanced service in return for the higher fee. As is the case here.

Had it been announced that the Court was introducing a bereavement service but to subsidize that they needed to increase the Court fees, few people could complain. After all the proposed new fee is not completely unfair when compared to other civil fees –

Eg :-

Personal injury claim where damages are claimed in the sum of £250,000.00 :
Issue fee : 4% of claim value

Probate dealing with £2m Estate :
Issue fee : 0.3% of Estate value

So the highest issue fee in probate would still be a fraction of other civil Court fees. That doesn't make it fair. It just makes is relatively less unfair.
