Whilst a couple may decide to avoid Probate Court fees by having their accounts in joint names, where their major asset is a jointly owned property it is increasingly common for the joint tenancy to be severed and the surviving spouse left a life interest with the reversion passing to children, perhaps of an earlier marriage. The fact that the estate has a capital asset worth more than £50,000 does not mean that there are commensurate liquid assets too.
