Like Seriously? Would this burden of proof apply to allegations of Dishonesty? If so the decison should be ripe for judicial review in my view on the basis that it is unfair and an affront to the rules of natural justice. The nature of allegations in other professions and the consquences for the professionals involved are generally different in my view than in the legal profession. In circumstances where we have a regulator that, in my view, cant be trusted not to serve the interets of pressure groups and political powers, this move is another step in the wrong direction. It leaves lawyers feeling more vunerable to subjective interpretations and would probably have a disproportionate effect on ethnic minority lawyers. The wisdom of generations past seems to have taken a long holiday leaving a literny of frankly self seeking and intellectualy shallow decsions.. in my opinion.
