The Court of Appeal judgment is correct. Read the judgment, see how the claimant solicitors tried to place an apportionment argument upon the terms of an order. Further, the court was correct to extend the time for payment by a few hours. All of this satellite litigation was all unnecessary and the matter would have been concluded long ago, without the further costs, if the point had not been taken. Litigators need sound judgment.
