My understanding is that once the claim is tracked into the multi track the fixed costs falls away so these cases have not been tracked as yet.. someone tell me if I am wrong.... the case is unfair and unequitable frankly as it assumes an ability to assess a case without medical evidence or a prognosis .. with tough penalties for getting it wrong although in really big cases fixed costs regimes could provide a premium to the claimant as the costs are based on damages levels. It's generally all fixed against the Claimants these days frankly you know the people who have been injured.. this issue needs reform so that limits on fixed costs only apply to quantum at a certain level..
