I have some sympathy with this view.

I started practising family law in 1972, when the current law was coming into force and going through its first tests. There used to be divorce hearings, even for undefended petitions. The allegations had to be proved. The arguments were about behaviour, adultery, co-respondents etc. Anger was vented during that process.

Now though, the anger and bitterness are saved for the financial and property stages and, tragically, often focus on disputes about the children.

I'm not sure that the present system is better than the old, let alone whether a new system would improve things.
