Hmmm. This is obviously right but I cannot help thinking that to expect an LiP to comply with the CPR, CCR and the RSC is somewhat unreasonable. The ideas behind the CPR were praiseworthy but failed to tale into account the propensity of Lawyers to attempt to pick holes in stuff. As a result the majority of the White Book is taken up in explaining what these (supposedly) simple rules mean. Some of those explanations (which are not available to Mr Ordinary-Guy) are pretty turgid and split hairs with a vengeance. If - as seems to be the agenda here - the idea is to get lawyers out of litigation then some help is going to have to be given to LiP's so that they can understand what their obligations to the court are and how they are supposed to be carried out.

A legal system that allows people who can afford a lawyer to lever an advantage because of their opponents inability to understand the rules they are supposed to follow is not one where there is equality of arms.
