I wonder how long it will be before the concept of the 'ghost solicitor' emerges? By that I mean litigants who employ a solicitor to advise and draft but who does not go on the record until, perhaps, the approach of trial. That enables the client to have the benefit of legal advice and the drafting of litigation documentation but, at the same time, to work to a timetable different to that imposed by the Rules from which, when required, the litigant can seek to be excused by pleading that he/she is a LiP and unaware of the Rules and the implication of non-compliance therewith. Food for thought, eh?
