The Law Society has called for legal aid to be exempt from the Consumer Contracts Regulations 2013, which came into force in June.
It said a number of the provisions are impractical and argued that the EU directive on which the regulations are based was never intended to apply to legal aid.
Case also features a successful application to allow remote evidence against claimant’s wishes.
Experts say drafting flaws may have been ironed out by new ruling on enforceability of agreement.
Independent inquiry 'has no pre-conceived answers’ and encourages ‘widest possible range of views’.
