IBA alarm on legal independence

The jurisdiction of England and Wales sounds at least three of the alarm bells about threats to legal independence set out in a major International Bar Association report. The report notes the ‘proliferation of new categories of unregulated legal professionals’ and the government’s role in the Legal Services Board.

CMC numbers may be slashed 

The number of claims management companies is likely to be slashed by half to just 100 once compulsory authorisation comes in, the government’s new head of claims management regulation predicted last week. Mark Boleat said regulation would cause many unscrupulous companies simply to withdraw from claims management.

Case sparks harassment warning

In Burton & Rule v De Vere Hotels, the Employment Appeal Tribunal upheld an appeal by two hotel employees who were found to have been racially harassed by guests while clearing tables following an act by comedian Bernard Manning. The appellants claimed their employer, the Greenalls Group, was responsible.

Survey of solicitors’ ethnic origins

Practitioners may be surprised to find in this year’s practising certificate application form a request for applicants to give details of their ethnic origins. The purpose is to compile statistical information about the numbers of solicitors from ethnic minority backgrounds. At present there is no reliable information.

Libel and slander

Perhaps with some prejudice, I regard defamation as one of the most interesting branches of the law. It is a branch of the law which is likely to increase in importance in a world daily becoming more literate and which in every field, be it newspaper, magazine or book, continues to show an increase in available reading matter.
