I think DAC had a duty to their client to say to them that under the 3 stage test applied in Denton it was very very likely that the costs budget would be allowed in and that taking this point could potentially backfire. If they gave the client that advice and were still told to proceed then all well and good.

I agree that if BAE wants to throw money at DAC on that basis then that is a matter for them and their shareholders.
