Without an examination of the reasons why litigation is so expensive the Jackson reforms cannot hope to control the actual cost. The long term effect will be an increasing 'own client' element of costs which will soon, mean that litigating over an issue with a value of less than £100,000 won't be worthwhile at all. Is that good for the rule of law?

Reform of the overly complex way litigation is conducted was always the answer but these reforms have added more front loading on top of the front loading added by Woolf.

A bit of research before meddling wouldn't have gone amiss either!
