I wanted to clarify one point in relation to your article about the standard of proof. You said that the ‘discussion paper… does not explicitly back requiring prosecutions to be proved “beyond reasonable doubt”’. This is not quite accurate.

The Law Society is keen to hear members’ views. However, I want to emphasise that the Society’s formal position at this point in time is to support the criminal standard of proof, for the reasons outlined in the discussion paper.

The discussion paper was issued following a debate at the last meeting of the Law Society Council and it reflects the Society’s agreed policy position.
