Comment

As barristers seem in practice far removed from reality and some might say even ethics, the cab rank rule has always been an empty lie as the Roger Casement example illustrates, where no barrister in England was 'available' and the great Roger Casement had to make do with AM Sullivan, the Kings lawyer in Ireland, and there are rare examples that I am aware of, of barristers carving out deals between themselves without taking instructions from solicitors and the end client, for those reasons the change might be a good thing.
