I do not know the specifics of this case and I cannot therefore comment upon the tactics of the MoD in this instance.

I can however confirm that the reported behaviour of the MoD in this case chimes with my own experience of dealing with it. My firm brought a case against the MoD (and another department) and the way they defended the case certainly cost the taxpayer much more than had they taken a sensible commercial view on the risks and liabilities.

The case I was involved in also settled eventually but not before the Department was facing the possibility of the case of Quark Fishing being overturned in the SC, a damaging finding of fraudulent concealment and the prospect of being ordered to disclose many documents which it was clear they were determined to keep out of the public domain.

Sometimes Government departments need reminding who they work for.
