It amuses me that lawyers still peddle the myth that the “law” and “justice” are branches of the same tree, they are not. The law is and always has been a compromise between the needs to society and the needs of the individual.
The immigration system, its processes and the law surrounding it is not fit for purpose. As such, change must be inevitable and necessary. It is not justice to hold an individual in limbo for 52+ weeks, for that individual or society.
Employing more tribunal members doesn’t lessen incompetent decisions that give rise to appeals, overly complex procedures heightens the risk and missteps which are then appealed.
Make the process simple and understandable, so that it can be deployed at non lawyers level and lessen the admin burden.
Something must be done, at least this govt is trying.
